THE REACH PROGRAMME

REACH is a regulation of the European Parliament and the European Council concerning the safe use of chemicals, through their registration, evaluation, and, in certain cases, the granting of authorizations and the imposition of restrictions on the trade and use of certain chemicals (applicable text available at http://eur-lex.europa.eu/en/index.htm – OJ L 136 of 29.05.2007). It came into force on June 1, 2007, replacing dozens of previously applicable community legal acts, including both regulations and directives that were introduced into Polish law by the Act of January 11, 2001, on chemical substances and preparations.

In principle, all chemicals are subject to the REACH regulations; however, several chemicals such as plant protection products, biocidal products, medicinal products, cosmetics, or food and feed additives, which are regulated by other community regulations, are exempt from some or nearly all provisions of the regulation. Additionally, substances sourced from nature are not subject to registration, provided they are not dangerous and have not been chemically modified.

REACH directly applies to the activities of producers and importers (from outside the EU) of chemical substances or preparations. It also regulates the activities of producers or importers (from outside the EU) of articles (such as building materials, electronics, toys, machinery, spare parts, textiles, and many others) that contain substances listed in Article 57 of the regulation or that intentionally release chemical substances during use. The regulation also concerns producers of preparations (such as paints, varnishes, oils, cleaning agents, and many others) as well as, to a certain extent, professional users of chemicals.
